A corpus of 60 articles published in Spanish, English, and Portuguese was analyzed to account for the integrative literature review on the concept of vulnerability from bioethics, identifying the following thematic trends: risk, susceptibility, autonomy, and culture in people and communities. The methodological approach has been mainly qualitative. We found that the disciplines that most addressed the concept belong to the human and social sciences. The authors recommend conducting studies of the concept from people’s perspectives and that ethics committees review (...) the informed consent and information guides according to these results. The categories give way to the concept of vulnerability, which must be analyzed beyond principlism in bioethics. (shrink)

Given two (positive) equivalence relations ∼ 1 , ∼ 2 on the set ω of natural numbers, we say that ∼ 1 is m-reducible to ∼ 2 if there exists a total recursive function h such that for every x, y ∈ ω, we have $x \sim_1 y \operatorname{iff} hx \sim_2 hy$ . We prove that the equivalence relation induced in ω by a positive precomplete numeration is complete with respect to this reducibility (and, moreover, a "uniformity property" holds). This (...) result allows us to state a classification theorem for positive equivalence relations (Theorem 2). We show that there exist nonisomorphic positive equivalence relations which are complete with respect to the above reducibility; in particular, we discuss the provable equivalence of a strong enough theory: this relation is complete with respect to reducibility but it does not correspond to a precomplete numeration. From this fact we deduce that an equivalence relation on ω can be strongly represented by a formula (see Definition 8) iff it is positive. At last, we interpret the situation from a topological point of view. Among other things, we generalize a result of Visser by showing that the topological space corresponding to a partition in e.i. sets is irreducible and we prove that the set of equivalence classes of true sentences is dense in the Lindenbaum algebra of the theory. It is well known that, in Peano arithmetic, there exists a formula Theor (x) which numerates the set of theorems. By Gödel's and Löb's results, we have that Theor (˹p˺) ≡ p implies p is a theorem ∼Theor (˹p˺) ≡ p implies p is provably equivalent to Theor (˹0 = 1˺). Therefore, the considered "equations" admit, up to provable equivalence, only one solution. In this paper we prove (Corollary 1) that, in general, if P (x) is an arbitrary formula built (...) from Theor (x), then the fixed-point of P (x) (which exists by the diagonalization lemma) is unique up to provable equivalence. In this work I hold that William James’s conception of religion is divided between what could be identified as his voluntarism and his idea of self-surrender. In my approach, James’s voluntarism is the heart of The Will to Believe, whereas the idea of self-surrender is the key to understand The Varieties of Religious Experience. These two works respond to a tension in James’s philosophy and canbe seen as two antagonistic intellectual projects. The analysis of this inner tension in James’s conception (...) of religion is the core of this paper. I will also state that his self-surrender notion, unlike his voluntarism, allows us to visualize an essential aspect of James’s conception, that is to say, its morbid aspect. (shrink)

A aproximação com o conceito do retrato se dá pela visão de Galienne e Pierre Francastel na difícil, se possível, tarefa de defini-lo. O conceito de ironia que emprego é a interpretação de Kierkegaard. Intentaremos completar el análisis de la relación entre Merleau-Ponty y distintas posiciones escépticas -típicamente restringido a textos más “canónicos” - a partir de su conferencia sobre Le primat de la perception. El fenomenólogo argumenta allí contra la “inducción pesimista” según la cual podemos, a la luz de la refutación de las hipótesis científicas pasadas, prever que las actuales son también falsas: invirtiendo la conclusión de esta inducción, afirma que las transformaciones de nuestro conocimiento son un proceso autocorrectivo, tal que ninguna (...) hipótesis es abandonada sino en la medida en que otra aparece como mejor. Esto nos hará problematizar la noción de refutación científica en Merleau-Ponty, quien ofrece como modelo del progreso epistémico la mutua sustitución de creencias perceptivas, que no involucra la consideración consciente de criterios racionales. Según señalaremos, este punto de partida no puede extrapolarse al caso de hipótesis sopesadas según sus respectivas virtudes. (shrink)

Esses críticos entendiam que Sartreutilizava a literatura como pretexto para propagar e defender suas teses políticas e filosóficas,produzindo assim um tipo de literatura engajada, distorcendo e empobrecendo o sentido nobreda arte das belles-lettres. Em resposta a essas críticas, a intenção de Sartre é fazer uma exaltaçãoda literatura, compreendendo-a como (...) um livre desvendamento do sentido de mundo por meiode um objeto imaginário, um pacto de generosidade entre autor e leitor. Com objetivo dediscutir o sentido filosófico da literatura, este artigo se fundamenta na ontologiafenomenológica de Sartre e nos argumentos apresentados pelo autor em resposta a seus críticos,apresentando o princípio de engajamento a partir do conceito de intencionalidade daconsciência e o sentido fenomenológico da imaginação, entendendo que se trata de umadiscussão que embasa filosoficamente o entendimento do autor sobre o que é a literatura e suaimportância para a constituição da subjetividade e afirmação da liberdade. In this paper an improved formulation of the classical tripartite view of knowledge is proposed and defended. This formulation solves Gettier's problem by making explicit what is concealed by the symbolic version of the tripartite definition, namely, the perspectival context in which concrete knowledge claims are evaluated.

In this paper is developed a reconstructive analysis of the conditions for both utterances constative and performative. These conditions were not presented by Austin (in that way), but we must deal with them, if we want that the distinction works. Under the light of this analysis is shown -against Austin -no compelling ground for the rejection of the distinction.

Although the scribbling stage of drawing has been historically regarded as meaningless and transitional, a sort of prelude to the "actual" drawing phase of childhood, recent studies have begun to re-evaluate this important moment of a child's development and find meaning in what was once considered mere motor activity and nothing more. The present study analyzes scribbling in all its subphases and discovers a clear intention behind young children's gestures. From expressing the dynamic qualities of an object and the child's (...) relationship with it, to gradually reducing itself to a simple contour of a content no more "alive" on the paper, but only in the child's own imagination, we trace the evolution of the line as a tool that toddlers use to communicate feelings and intentions to the world that surrounds them. We will provide a selected number of graphical examples that are representative of our theory. These drawings (13 in total) were extracted from a much wider sample derived from our studies on children's graphical-pictorial abilities, conducted on children aged 0 to 3 years in various Italian nurseries. Our results appear to indicate that scribbling evolves through a series of stages, and that early graphical activity in children is sparked and maintained by their relationship with their caregivers and the desire to communicate with them. This paper argues that the positive allocative decisions paradigmatically carried out by the application of legal rules are a necessary condition for arguments about particular justice (i.e., distributive and commutative justice) to make sense. If one shifts the focus from the distinction between distributive and commutative justice to what the two aspects of particular justice are for, namely, providing criteria to judge the allocation of goods, it becomes clear that the distinction is conceptually unstable. The paper argues that stabilizing the (...) distinction is worthwhile and that this can only be accomplished by the introduction of positive allocation schemes. (shrink)

Our environment is changing rapidly, as is the spectrum of possible relationships we can entertain with it. Against this background, one important task emerging in contemporary philosophical discussion concerns defining the status of contemporary images and the "iconic spaces" we encounter with ever-increasing frequency in their various forms. Within this context, the dimension of perception seems to be losing its primacy over the image, making a philosophical description of the relationships between image and reality all the more necessary. Among images, (...) the classical distinction between documentary and fiction has been drastically called into question, and along with it the nature of the emotions and values we experience in these two domains. Rozzoni promotes a phenomenology of the image, that is, a return to a description of images that starts from their essential features while avoiding simplistic dichotomies. By elucidating images’ intimate relationship with phantasy and aesthetic experience and their role in shaping our experience of "reality," this book develops a perspectival notion of "truth" intended to shed light on our contemporary interactions with images and the events, emotions, and values we experience through them. In this paper we continue this investigation, comparing the hypergame argument with the diagonal one, in order to find a proof schema. In particular, in Theorems 9 and 10 we discuss the complexity of the set of founded elements in a recursively enumerable relation on the set N of natural numbers, in the framework of reduction between relations. This paper proposes an epistemological approach to analyse social-ecological systems from a process perspective in order to better tackle the co-constitution of the social and the ecological and the dynamism of these systems. It highlights the usefulness of rethinking our conceptual tools taking processes and relations as the main constituents of reality instead of fundamental substances or essences. We introduce the concept of experience as understood in radical empiricism to critically revise our available concepts through focusing on the concept of (...) difference, exploring apparent contradictions and engaging in assemblage thinking. With growing vigor, political philosophers have started questioning the Westphalian system of states as the main actors in the international arena and, within it, the doctrine of Permanent Sovereignty over Natural Resources. In this article I add to these questionings by showing that, when it comes to migratory natural resources, i.e., migratory species, a plausible theory of territorial rights should advocate a regime of shared sovereignty among states. This means that one single entity should represent their interests and maybe also (...) those of third parties, managing and making decisions over the resource as a whole. Although such a regime might be the tacit goal of existing international conventions regarding wildlife, it remains untheorized in political philosophy and largely under-theorized in international law. By presenting the critical situation of the monarch butterfly in North America, I point to the inadequacy of the compartmentalized current regime, which generates injustice in migration; namely, the phenomenon whereby range states of a given species may neglect or over-exploit it while in their territory, to the detriment of others. I suggest that more flexible and imaginative governance arrangements are needed to deal in a better way with these and similar natural resources. (shrink)

Given the grim global statistics of extreme poverty and socioeconomic inequalities, moral and political philosophers have focused on the duties of justice and assistance that arise therefrom. What the needy are morally permitted to do for themselves in this context has been, however, a mostly overlooked question. Reviving a medieval and early modern account of the right of necessity, I propose that a chronically deprived agent has a right to take, use and/or occupy whatever material resources are required to guarantee (...) her self-preservation, or the means necessary to acquire them. There are three individually necessary and jointly sufficient conditions: the need is basic, the claimant does not violate other equally important moral interests, and it is a last resort. I present two recommendations to be followed by the claimants, and offer some examples where this principle may be applied today. I reply to the objections that understanding the right of necessity in this way kills its intuitive plausibility, and that it is a remedy worse than the disease. I conclude that, while not the best solution for the problem of global poverty, the exercise of this right should be accepted if we believe in the human right to subsistence. (shrink)

The Scottish sentimentalist Francis Hutcheson and the Chinese Confucianist Mencius give benevolence (ren) a key place in their respective moral theories, as the first and foundational virtue. Leaving aside differences in style and method, my purpose in this essay is to underline this similarity by focusing on four common features: first, benevolence springs from compassion, an innate and universal feeling shared by all human beings; second, its objects are not only human beings but also animals; third, it is sensitive to (...) proximity; and finally, it has to be constantly cultivated in order to become a character trait. I will conclude with some brief remarks as to how this understanding of benevolence as rooted in feeling rather than reason, and in personal rather than impersonal relationships, helps to illuminate part of the discussion in moral philosophy today. In this essay I focus on Grotius’s account of the _suum_ and examine what it is, what things it includes, what rights it gives rise to, (...) and how it is extended in the transition from the state of nature to civil society. I then briefly suggest that reviving this concept could help to illuminate the current discussion on the foundations of basic human rights, and to re-evaluate cases where these seem to clash with property rights. Anna Stilz’s Territorial Sovereignty (2019) aims to be a revisionist account of territorial rights that puts the value of individual autonomy first, without giving up the value of collective self-determination. In what follows I examine Stilz’s definition of occupancy rights and her emphasis on the moral relevance of what she calls ‘located’ life plans. I suggest that, if it aims at being truly revisionist, her theory should work with a broader definition of occupancy. So long as it doesn’t, these rights (...) will be mainly the preserve of groups of settlers and peoples with predictable patterns of movement. Moreover, insofar as occupancy rights ground collective rights to self-determination, they actually have the potential to trump individual rights to what I call ‘dynamic’ or non-located occupancy. This is worrying, I claim, for at least two reasons. First, rights to dynamic occupancy are arguably as central for respecting individual autonomy as rights to located occupancy. And second, rights to dynamic ocupancy should be seen as key in helping to form the kind of political allegiances required to overcome the most pressing collective action problems that humanity faces. Given the conceptual gap in the global justice debate today (where most of the talk is about the duties of the rich, but little is said about what the poor may do for themselves), in this article I reintroduce the idea of a right of necessity. I first delineate a normative framework for such a right, inspired by these historical accounts. I then offer a contemporary case where the exercise of the right of necessity would be morally legitimate according to (...) that framework – even though illegal and probably condemned by the standard moral norms. The case is that of a small group of Paraguayan campesinos (small farmers) suffering from the effects of a severe drought. In the third part, I introduce the concept of noncivil disobedience: I call an act of noncivil disobedience a conscientious, public, illegal and forcible act whose performance, while not necessarily intended directly as a means to bring about social and/or political change, may help to trigger these changes indirectly. In the fourth part, I suggest that certain instances where the right of necessity is overtly exercised – as in the case of the famine-struck Paraguayan campesinos – may also be interpreted in terms of noncivil disobedience, insofar as they serve a double function: as a means of satisfying immediate need, and as a marker of discontent in a society where the equal rights of individuals are a nominal ideal which remains unfulfilled in practice. I then address two objections that may be raised against resurrecting the idea of a right of necessity and identifying it in certain instances with noncivil disobedience. I conclude by suggesting that, at the point of convergence between the two, a basic right like the right of necessity recovers its value as an active, (rather than passive) entitlement of its holders, while the use of force enters the picture as a legitimate means that – at least under certain circumstances – may be resorted to within the limits of civil society. Resumo: O artigo a seguir tem como objetivo expor o pensamento hermenêutico de Friedrich Schleiermacher, levando em conta o contexto germinativo fértil de sua obra e sua influente posição filosófica, no âmbito do “primeiro romantismo alemão”. Schleiermacher renuncia a um importante fundamento transcendental a-histórico, em favor de uma compreensão situada, a qual se configura através do diálogo. A hipótese central deste artigo alerta que o desenvolvimento paralelo e sistemático das lições sobre ética, dialética e hermenêutica, em Schleiermacher, não é mera (...) coincidência, muito menos um sintoma isolado, senão que revela um projeto de caráter orgânico. Por um lado, será examinado - à luz de seus textos - o papel da linguagem como variável histórica e social para a compreensão e, por outro, algumas reflexões sobre as novas possibilidades de seu método hermenêutico e suas implicações, para a reflexão filosófica contemporânea.: The following article aims to expose the hermeneutic thought by Friedrich Schleiermacher, considering the fertile germinal context of his work and his influential philosophical position within the framework of “early romanticism”. Schleiermacher renounces an ahistorical transcendental foundation in favor of a situated understanding, which is configured through dialog. The central hypothesis of this article warns that the parallel and systematic development of the lessons on ethics, dialectics and hermeneutics in Schleiermacher is not a mere coincidence, much less an isolated symptom, but reveals a project of an organic nature. On the one hand, it is examined -in the light of their texts- the role of language as a historical and social variable for understanding and, on the other hand, some reflections on the new possibilities of his hermeneutical method and its consequences for contemporary philosophical reflection. By virtue of the Antarctic Treaty, signed in 1959, the territorial claims to Antarctica of seven of the original signatories were held in abeyance or “frozen.” Considered by many as an exemplar of international law, the Antarctic Treaty System has come to be increasingly questioned, however, in a very much changed global scenario that presents new challenges to the governance of the White Continent. In this context, it is necessary to gain a clearer understanding of the moral weight of those (...) initial claims, which stand as a cornerstone of the treaty. The aim of this article is to offer an appraisal of such claims, which may be divided into two main kinds: those grounded on some relevant link to the territory, and those grounded on official documents and geographical doctrines. After pointing to the limitations and challenges that they face, I conclude with some remarks about how this assessment ought to serve as a starting point to rethink the territorial status of Antarctica. In Justice and Natural Resources: An Egalitarian Theory, Chris Armstrong proposes a version of global egalitarianism that – contra the default renderings of this approach – takes individual attachment to specific resources into account. By doing this, his theory has the potential for greening global egalitarianism both in terms of procedure and scope. In terms of procedure, its broad account of attachment and its focus on individuals rather than groups connects with participatory governance and management and, ultimately, participatory democracy – (...) an essential ingredient in the toolkit of green politics and policy-making. In terms of scope, because it does not commit itself to any particular moral framework, Armstrong’s theory leaves the door open for non-human animals to become subjects of justice, thus extending the realm of the latter beyond its traditionally anthropocentric borders. I conclude that these greenings are promising, but not trouble-free. (shrink)
